General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the "GTC") apply to any purchase made by a natural person acting as a consumer (hereinafter the "Customer") on the website www.institut-kallista.com (hereinafter the "Site") from:

(hereinafter the "Seller")

The Customer is informed that professionals wishing to place an order must contact the sales department to benefit from separate contractual terms.

Any order placed on the Site implies full and unreserved acceptance of these GTC.

Article 1 — Definitions

"Customer": any natural person making a purchase on the Site for personal needs.

"Product(s)": all cosmetic products and accessories offered for sale on the Site.

"Order": any purchase of one or more Products made by the Customer on the Site.

"Delivery": the physical handover of the Product to the Customer or a third party designated by them.

Article 2 — Purpose

These GTC govern the sale of Products by the Seller to its Customers via the Site.

The applicable GTC are those in force on the date the Order is placed.

Article 3 — Products

The Products offered for sale are those described on the Site on the day of consultation. Photographs are presented with the greatest care but do not constitute a contractual element.

The Seller reserves the right to modify the range of Products at any time. All Products are new and comply with European legislation and applicable standards in France.

Article 4 — Prices

Prices are indicated in euros, inclusive of all taxes, including VAT at the current rate. Delivery costs are added to the price of the Products and are indicated before the Order is validated.

The Seller reserves the right to modify its prices. Products are invoiced at the price in effect at the time the Order is validated.

Article 5 — Orders

5.1 Capacity

To place an order, the Customer must be at least 18 years old or have the consent of their legal representatives.

5.2 Placement

The Customer selects the Products, adds them to the cart, verifies their Order, then proceeds to payment. The Order is registered after payment confirmation.

5.3 Confirmation

A confirmation email is sent to the Customer. This email does not constitute an invoice. The invoice is enclosed with the package during Delivery.

5.4 Availability

Products are offered within the limits of available stock. In case of unavailability, the Customer is informed and can choose between a refund or waiting for restocking.

Article 6 — Payment

6.1 Payment methods

The Customer can pay for their Order by: credit card (Visa, Mastercard), PayPal, Apple Pay, bank transfer, bank check.

Credit card transactions are processed securely by our payment service provider. Banking data is neither stored nor accessible by the Seller.

Payment by check is accepted under the conditions specified on the Site.

6.2 Payment in installments with Oney

The Customer can pay for their Order in 3 or 4 installments by credit card via Oney Bank, for purchases from €100 to €3,000.

This offer is reserved for individuals residing in France, holding a Visa or Mastercard credit card whose validity date is longer than the financing period. Cards with systematic authorization (Electron, Maestro, Nickel, etc.), e-cards, Indigo cards, and American Express are not accepted.

By choosing Oney payment, the Customer accepts Oney's General Terms and Conditions of Sale and Legal Notice, accessible from the payment page.

3-installment payment: a down payment debited upon shipment, then 2 monthly payments at 30 and 60 days. Fees: 1.61% of the amount (maximum €25). Fixed APR of 21.63%.

4-installment payment: a down payment debited upon shipment, then 3 monthly payments at 30, 60, and 90 days. Fees: 2.40% of the amount (maximum €50). Fixed APR of 21.61%.

Oney Bank reserves the right to accept or refuse the financing request. The Customer has a withdrawal period of 14 days.

6.3 Payment date

The amount is debited at the time of payment validation (or according to the Oney payment schedule, if applicable).

Article 7 — Delivery

7.1 Delivery zones

Products are delivered in mainland France and in European Union countries. Certain brands distributed on the Site (notably Sothys) are subject to territorial restrictions and can only be delivered in mainland France.

Customs fees (approximately 8.1%) may apply for orders shipped to Switzerland.

7.2 Lead times

Shipping and delivery times are indicated on the Site. Products are shipped within a maximum of 30 days from the confirmation of payment. In case of exceeding this period, the Customer may cancel their Order in accordance with Article L.216-2 of the French Consumer Code.

7.3 Receipt

The Customer checks the condition of the package upon receipt. In case of damage, the Customer makes reservations with the carrier and informs the Seller within 3 working days.

7.4 Transfer of risks

The transfer of risks takes place when the Customer physically takes possession of the Product.

7.5 Package returned to sender

If the Customer has not collected their package from the relay point designated for its delivery, it is automatically returned to the sender after the retention period by the delivery location expires. In this case, the Seller reserves the right to apply return fees if the Customer wishes a refund or re-shipping fees if the Customer wishes to be delivered again.

Article 8 — Right of withdrawal

8.1 Principle

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal, without justification or penalty.

8.2 Exclusions

The right of withdrawal does not apply to sealed Products that cannot be returned for reasons of health protection or hygiene and that have been unsealed by the Customer after Delivery (Article L.221-28, 5° of the French Consumer Code).

8.3 Exercise

The Customer notifies their decision by email to bonjour@institut-kallista.com or by mail to: SAS CAP 2030, 118 avenue des Charmes, 74140 Sciez-sur-Léman.

8.4 Return

The Product must be returned in its original packaging, in good condition, within 14 days following notification.

Return costs are borne by the Customer and amount to €4.90.

8.5 Refund

The refund is made within 14 days from the recovery of the Product or proof of shipment. The refund is made using the same payment method used for the Order.

Article 9 — Legal guarantees

9.1 Legal guarantee of conformity

The Seller is obliged to deliver goods that conform to the contract, in accordance with Articles L.217-1 et seq. of the French Consumer Code (Ordinance No. 2021-1247 of September 29, 2021).

The Customer benefits from a period of two (2) years from delivery to act. During this period, the Customer does not have to prove the prior existence of the defect.

In case of a defect, the Customer chooses between repair and replacement, or failing that, a price reduction or cancellation of the contract.

9.2 Guarantee against hidden defects

The Seller is bound by the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The Customer can act within 2 years from the discovery of the defect.

Article 10 — Liability

The Seller's liability cannot be engaged in case of force majeure or an event beyond its control. The Seller's liability is limited to the amount of the Order concerned.

Article 11 — Personal data

Personal data is processed in accordance with the GDPR and the Data Protection Act. The procedures are detailed in the Site's Privacy Policy.

Article 12 — Intellectual property

All elements of the Site are protected by intellectual property law. Any reproduction is prohibited without the Seller's prior written consent.

Article 13 — Archiving

Any contract corresponding to an order for an amount greater than €1 including tax is archived for 10 years in accordance with Article L.213-1 of the French Consumer Code. The Customer can request a copy.

Article 14 — Mediation and dispute resolution

In case of a dispute, the Customer first contacts the Seller. Failing a solution, the Customer may have recourse to a consumer mediator.

Article 15 — Applicable law

These GTC are governed by French law. The European consumer may bring legal action before the court of their domicile in accordance with Regulation (EU) No. 1215/2012.
